1. About Nex Connect
These Terms & Conditions (“Terms”) govern your use of Nex Connect’s AI platform and services (“Services”). By signing up, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
The Services are provided by Nex Connect (operated by The Towers Family Trust T/As Nex Connect AI, ABN 50727695917), located at Level 35, 100 Barangaroo Avenue, Barangaroo NSW 2000, Australia.
These Terms are governed by the laws of New South Wales, Australia.
2. Description of Services
Nex Connect provides AI-powered reception and booking automation for small businesses through our branded web dashboard and the Lead Connector mobile app.
The Services include, but are not limited to:
AI receptionists and booking bots
CRM and contact management tools
Two-way messaging, calls, and email
Appointment scheduling
Marketing automation and analytics tools
Nex Connect provides done-for-you onboarding and setup for all core features within your selected plan. This includes configuration of AI reception, booking systems, and integrations. Other tools (e.g., Ads Manager, Social Planner) are self-service with access to guides and tutorials.
We may use trusted third-party providers such as GoHighLevel, Google, and Stripe as part of our Services.
3. Access and Use
3.1 Account Access
Clients receive full admin access to their account. User limits depend on the plan selected:
Starter: 1 user / 200 contacts
Growth: 3 users / 500 contacts
Elite: Unlimited users and contacts
You are responsible for all activity under your account, including that of authorized users.
3.2 Acceptable Use
You must not use the Services for unlawful, misleading, spam, or harmful activity. Nex Connect may suspend or terminate your access immediately and without refund for any breach.
3.3 Ownership
All software, automations, and AI configurations remain the intellectual property of Nex Connect. You retain ownership of your customer data and may export it upon cancellation. You may not reproduce, resell, or reuse our systems or content without written consent.
4. Billing and Payments
4.1 Subscription and Renewal
Services are billed monthly or annually (depending on your selection) and renew automatically unless cancelled within the platform.
4.2 Payment Processor
All payments are processed securely via Stripe. By subscribing, you authorize automatic billing.
4.3 Credits
Each active subscription includes $10 in usage credit per month. Additional usage (calls, texts, emails, or AI tasks) is billed at standard rates.
4.4 Cancellations
You may cancel anytime through your dashboard. Cancellation takes effect at the end of the current billing cycle.
4.5 Refunds
All payments are non-refundable, except as required by law.
4.6 Suspension for Non-Payment
Accounts overdue by more than 7 days may be suspended. We may delete data after 30 days of non-payment.
5. Client Responsibilities
You are solely responsible for ensuring compliance with all privacy, spam, and marketing laws, including the Spam Act 2003 (Cth) and Privacy Act 1988 (Cth).
You must obtain consent from your customers before collecting or processing their data through the platform.
You are responsible for maintaining the accuracy of all data and settings within your account.
Nex Connect accepts no liability for messages, calls, or content you generate or distribute.
6. Data and Privacy
Your data will be handled in accordance with our Privacy Policy, available at: https://nexconnect.ai/privacy
We retain client data for up to 30 days after cancellation or termination, after which it may be permanently deleted.
We may use anonymized or aggregated data for internal analytics and marketing purposes but will never sell or disclose identifiable client data to competitors.
7. Suspension and Termination
We may suspend or terminate your access, without refund, if:
You breach these Terms
Payment fails or remains overdue beyond the grace period
Your use threatens system integrity or violates laws
We reserve the right to discontinue or change features or integrations at any time.
8. Intellectual Property and Confidentiality
All technology, software, branding, and related intellectual property belong to Nex Connect or our licensors. Clients may not reverse engineer, copy, or resell any part of the Services.
We agree not to publicly use your name, logo, or testimonial without your explicit permission.
9. Warranties and Disclaimers
The Services are provided on an “as-is” and “as-available” basis.
We make no guarantees about uptime, performance, or business outcomes.
We are not liable for any indirect, consequential, or incidental losses, including lost revenue or missed bookings.
Our total liability for any claim is limited to the amount you paid in the preceding one-month period.
10. Dispute Resolution
Before pursuing legal action, both parties agree to attempt resolution through good-faith mediation, followed by binding arbitration in New South Wales, Australia, if necessary.
No party may join a class action or representative proceeding against the other.
11. Affiliates and Reselling
Nex Connect may operate an affiliate program under its own terms.
No client may resell, white-label, or redistribute the Services without written approval.
12. Modifications
We may update these Terms from time to time. Changes take effect upon notice sent to your registered email address. Continued use after notification constitutes acceptance.
